Intellectual Property Infringement Policy

1. Introduction

Tantralux is an online advertising directory. All content — text, images, videos and other material — published in listings is uploaded independently by third-party, independent advertisers, who are solely responsible for it.

The site operator acts as a hosting service provider within the meaning of Directive 2000/31/EC and Regulation (EU) 2022/2065 (Digital Services Act) and exercises no systematic prior control over the content uploaded.

We respect the intellectual property rights of others and require our users to do the same. Anyone who believes that content published on Tantralux infringes their copyright, trademark or other intellectual property rights may report it in accordance with the procedure described below.

2. How to submit a report

In order to be processed, the report must contain:

  • Identification of the work whose infringement is alleged (description of the image, text or material; where available, the URL of the original publication or other evidence of priority);
  • The exact URL of the Tantralux page where the contested content is published, with precise identification of the element (e.g. which photograph in the gallery);
  • Ownership of the right: a statement that you are the owner of the right or a person authorized to act on their behalf, with any supporting documentation;
  • Contact details of the reporter: first and last name or company name, address, email, and telephone number if any;
  • A statement of good faith, by which the reporter affirms in good faith that the contested use is not authorized by the rights holder, its agent or the law;
  • A statement of accuracy, by which the reporter affirms that the information provided is accurate and that they are aware of the liability arising from unfounded reports;

Incomplete reports, or reports that do not allow the contested content to be identified precisely, cannot be processed; we will notify the reporter, indicating the missing elements.

3. Handling of the report

We confirm receipt of every report without delay.

We examine the report in a timely, diligent, non-arbitrary and objective manner. If the infringement is manifest or otherwise well-founded, we proceed to remove or disable access to the contested content within 48 hours of receiving a complete report.

We inform the reporter of the outcome of the review and simultaneously notify the advertiser of the removal, stating the reasons and the possibilities of contesting it, pursuant to Article 17 of Regulation (EU) 2022/2065.

4. Counter-notice

An advertiser whose content has been removed may submit a counter-notice by writing to dmca@tantralux.com within 14 days of the notification, indicating:

  • the removed content and the URL where it was published;
  • the reasons why they consider the removal unfounded (for example: ownership of the right, license to use, release from the person depicted, self-produced content);
  • the supporting documentation;
  • their contact details and a statement affirming the accuracy of what is stated.

Once the counter-notice has been assessed, if the advertiser's reasons are found to be well-founded, the content is restored and we notify both parties. In the event of disputes requiring the determination of questions of fact or law that cannot be resolved summarily, the content remains removed as a precaution until the dispute between the parties is settled in the competent forums.

5. Repeat infringers

We adopt a repeat-infringer suspension policy: accounts subject to repeated well-founded reports are suspended and, in the most serious or repeated cases, permanently closed with no right to any refund, pursuant to Article 23 of Regulation (EU) 2022/2065 and our Terms and Conditions.

6. Abusive reports

Manifestly unfounded reports, or reports submitted for vexatious, competitive or harassing purposes, will be rejected. We reserve the right to restrict, after warning, the processing of reports from parties who frequently submit manifestly unfounded ones. Anyone who submits a report making false statements may be held liable for the damage caused.

7. Advertisers' obligations

By uploading any content, the advertiser warrants that they:

  • are the owner of the rights to the uploaded material, or hold a suitable license or authorization for publication;
  • have obtained the written consent of every person depicted to the publication of their images;
  • do not use third-party trademarks, logos, texts or photographs without authorization.

The advertiser indemnifies the operator against any third-party claim arising from breach of these warranties.

8. Site content

The trademark, logo, structure, graphics, editorial texts, database and code of Tantralux are owned by Tantralux SRL and protected by applicable law. Their reproduction, systematic extraction and reuse without written authorization are prohibited.

9. Other reports

For reports concerning illegal content other than intellectual property — in particular images published without consent, content depicting minors or situations of exploitation — write immediately to abuse@tantralux.com. Such reports have absolute priority and are examined within 24 hours.
